IMPORTANT NOTICE — PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS SITE

These Terms of Use (“Terms”) constitute a legal agreement between you (“User”) and Faery By Mary Photography (“Photographer, ” “we, ” “us, ” or “our”), governing your access and use of our website at faerybymary.com, including all related services, transactions, and materials provided through the Site. By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of this Site immediately.

1. INTELLECTUAL PROPERTY RIGHTS

Faery By Mary Photography retains exclusive intellectual property rights to all text, logos, images, trademarks, design elements, and other protected materials found on the Site. Any reproduction, distribution, modification, or unauthorized use of these materials without prior written consent is strictly prohibited.

You are granted a limited, non-exclusive, non-transferable license to access and use purchased digital products for personal, non-commercial use. This license does not grant ownership or permission to reproduce, resell, or modify our products beyond completing necessary template information.

2. CONTACT & COMMUNICATION

By using this Site and submitting personal information, you consent to being contacted via email, phone, or other communication methods regarding services, promotions, or policy updates. If you wish to opt out, you may do so by contacting us at faerybymary@gmail.com.

3. BOOKING & PAYMENT TERMS

  • A $100 non-refundable booking fee is required to secure a session date. This amount is applied toward the total session fee but serves as a cancellation fee if the session is canceled.
  • The remaining balance must be paid in full on the session date before services are rendered.
  • Once services are rendered, Client must pay the service fee at the end of the session. If the fee is not timely paid, Photographer may withhold Client’s access to the photographic materials from the session.

4. CANCELLATIONS & RESCHEDULING

  • Cancellations made at least 5 days in advance allow for rebooking without losing the deposit.
  • Cancellations within 2 days or no-shows forfeit the booking fee and require a new deposit for rescheduling.
  • Clients may reschedule with at least 24 hours' notice, with a maximum of two reschedules per session within six months.
  • Special or seasonal promotions may have different rescheduling policies depending on availability.
  • If the Client does not show up within 30 minutes of the scheduled session start time without notice, the Photographer has the right to leave, and the booking fee will not be refunded or transferred.

5. SESSION ATTENDANCE & TIMELINESS

  • Clients must arrive on time for scheduled sessions. Late arrivals reduce the session duration accordingly.
  • If the photographer is late, additional time will be added to the session.
  • The client may extend the session if the photographer is available, with additional fees per hour as listed on faerybymary.com.
  • If the Client creates a toxic environment or behaves disrespectfully, the Photographer reserves the right to end the session and charge the full package fee.

6. ADDITIONAL FEES

  • Clients are responsible for all location-related costs, including transportation, permits, parking, studio rental, travel, and other expenses.
  • Any additional services not outlined in the original agreement are subject to additional charges at current rates.

7. LIABILITY & FORCE MAJEURE

  • If the photographer is unable to fulfill contractual obligations due to unforeseen circumstances (e.g., illness, injury, equipment failure, force majeure), the booking fee and any prepaid amounts will be refunded.
  • The photographer is not liable for damages or losses beyond the total session fee.
  • The Photographer shall not be liable for consequential, emotional, third-party, punitive, or any other damages, including attorney’s fees, resulting from Photographer’s services or lack thereof.

8. IMAGE DELIVERY & EDITING

  • Clients receive original, unprocessed JPEG files in compressed resolution within 72 hours after full payment.
  • Clients must select images for editing, with the number of edits determined by the package.
  • Edited images will be delivered within 1-6 weeks, depending on workload and session type.
  • Edited images are available for download for 3 months of delivery, after which they may be deleted unless the client purchases an extension service.
  • Additional retouching services are available at extra cost.

9. COPYRIGHT, USAGE RIGHTS & NON-DISCLOSURE AGREEMENT

  • The photographer retains full copyright ownership of all images.
  • Clients may use images for personal, non-commercial purposes only.
  • Clients must credit @faerybymary when posting images online.
  • Clients may not alter images or submit them to third parties without prior written consent.
  • The photographer reserves the right to use images for portfolio, marketing, and business purposes.

10. MODEL RELEASE

This photography contract serves as a model release. This grants Photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. Client waives the right to inspect any images produced using the images or footage from the events in this contract and the right to restrict the use of the images or footage from the listed events by the Photographer.

11. NON-USAGE FEE

  • If a client wants to keep their images confidential and out of the portfolio and social media, a Privacy Fee of $750 applies. This fee serves as compensation for the Photographer’s creative work and covers the potential loss of marketing opportunities associated with the inability to publicly showcase the work. 
  • If a client wishes to purchase full rights to specific images, the cost per image is $1000.

12. TFP, FREE & PROMOTIONAL SHOOTS

  • For all TFP (Time for Print), free, or promotional shoots the Participant automatically grants the Photographer full rights to use, modify, and distribute the images for portfolio, marketing, and business purposes. The Photographer retains full copyright ownership. 
  • Participants acknowledge that they receive professional photography services in exchange for allowing the photographer to use the images.
  • Participants may use images for personal promotion with mandatory credit to @faerybymary, but cannot sell, alter, or distribute them for commercial purposes without written permission.
  • If a Participant later requests image removal from the Photographer’s portfolio or social media, a $1500 fee applies. This fee covers the photographer’s time, effort, loss of portfolio exposure, and administrative costs for removing and restricting the images.
  • Participants may purchase full rights to specific images for $1000 per image, granting them exclusive ownership.
  • By participating, Participants waive the right to inspect or approve the final images and release the Photographer from any claims related to lawful image use.

13. SAFE WORKING ENVIRONMENT

  • Clients must provide a safe and professional environment for the photographer.
  • The photographer reserves the right to leave without refund if faced with harassment, threats, unsafe conditions, or illegal requests.

14. LIMITATION OF LIABILITY

  • Faery By Mary Photography is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, or data loss, arising from the use of its services or website.
  • The Photographer’s total liability for any claims related to services shall not exceed the total amount paid by the Client for the session.

15. PRIVACY POLICY

  • The Photographer collects personal information solely for the purpose of scheduling, communication, and service fulfillment.
  • Personal information will not be shared, sold, or disclosed to third parties except as required by law.
  • By using this website, Clients consent to the collection and use of their personal data in accordance with this policy.

16. CHANGES TO TERMS

  • Faery By Mary Photography reserves the right to modify or update these Terms at any time.
  • Clients will be notified of significant changes via email or an announcement on the website.
  • Continued use of the website or services after changes take effect constitutes acceptance of the revised Terms.

17. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of New York. Any disputes will be resolved in New York courts. Faery By Mary Photography reserves the right to modify these Terms at any time without notice.

18. SEVERABILITY

  • If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
